1. About the Foundation
Nature Based Therapy Foundation LTD (“the Foundation”, “we”, “us” or “our”) is an Australian not-for-profit organisation and registered charity with the Australian Charities and Not-for-profits Commission (ACNC).
The Foundation exists to promote health and wellbeing through prevention, early intervention, education, community connection and connection with the natural world.

2. Website use
You may use this website for lawful personal, educational and informational purposes.
You must not:

· Attempt to gain unauthorised access to the website or associated systems

3. Donations
Donations made to the Foundation are used to support its charitable purposes, programs and activities.

The Foundation has Deductible Gift Recipient (DGR) status. Whether a particular contribution is tax deductible will depend on the nature of the payment and applicable Australian taxation requirements.

Unless required by law or an error has occurred in processing a payment, donations are generally non-refundable.
4. Foundation Shop
Purchases through the Foundation Shop help support the charitable activities of the Foundation.
Product descriptions, availability and pricing may change from time to time.
Where products are manufactured, fulfilled or delivered by third-party providers, delivery times may be affected by circumstances outside the Foundation’s control.
Nothing in these Terms & Conditions excludes rights or remedies that cannot lawfully be excluded under the Australian Consumer Law.
5. Programs, workshops and events
The Foundation may offer community wellbeing programs, workshops, retreats, educational activities and other events.
Individual programs may have additional registration requirements, eligibility criteria, cancellation arrangements or participant conditions. These will be communicated where applicable.
Unless otherwise stated, registration is personal and cannot be transferred to another person without approval.
The Foundation may reasonably modify, postpone or cancel a program or event where circumstances require it. Where the Foundation cancels a paid event, participants will be advised of the available options.
6. Health and wellbeing information
Information and resources provided through this website are intended for general health promotion, wellbeing and educational purposes.
They are not intended to replace individual medical, psychological, psychiatric or other professional healthcare advice, diagnosis or treatment.
Participation in Foundation programs does not establish a therapeutic or clinical relationship unless this is expressly stated as part of a particular service.

7. Intellectual Property
Unless otherwise stated, website content and materials created specifically for and owned by Nature Based Therapy Foundation LTD remain the intellectual property of the Foundation or are used by the Foundation with permission.
This may include text, graphics, photographs, videos, educational resources, program materials and other content.
Pre-existing Nature Based Therapy intellectual property
The Foundation may use certain concepts, frameworks, educational materials, methodologies, programs, resources, trademarks or other intellectual property developed independently by Kit Kline and/or Nature Based Therapy.
Where such intellectual property is made available to or used by the Foundation under licence or with permission, ownership remains with the original intellectual property owner.
Use of this intellectual property by the Foundation does not constitute an assignment, transfer or donation of ownership to the Foundation.
Nothing contained on this website or within a Foundation program should be interpreted as transferring ownership of pre-existing Nature Based Therapy intellectual property to Nature Based Therapy Foundation LTD unless expressly agreed in a separate written intellectual property assignment.
Any licence granted to the Foundation is subject to the terms of the relevant written licence or other agreement between the Foundation and the intellectual property owner.
Use by website visitors and participants
Unless expressly permitted, Foundation and licensed Nature Based Therapy materials may not be:

· Distributed

8. Nature Based Therapy Foundation and Nature Based Therapy
Nature Based Therapy Foundation LTD is a separate organisation from the Nature Based Therapy business and associated commercial education, training and professional services.
The Foundation’s use of Nature Based Therapy intellectual property, programs or resources does not by itself give the Foundation ownership of the Nature Based Therapy business, brand, methodology, training programs or other pre-existing intellectual property.
Where the organisations collaborate, their respective roles and responsibilities may be governed by separate agreements.
9. Third-party services and links
The website may contain links to third-party websites or use external providers for services including payments, ecommerce, email communications, event registration or other functions.
The Foundation is not responsible for the content, availability or practices of independent third-party websites.
